We use the store system of the service provider Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"), for the purpose of hosting and displaying the online store on the basis of processing on our behalf. 7) Data processing when opening a customer account and for contract processing
According to Art. 6 (1) lit. b DSGVO, personal data will continue to be collected and processed if you provide it to us for the purpose of executing a contract or opening a customer account. Which data is collected can be seen from the respective input forms. Deletion of your customer account is possible at any time and can be done by sending a message to the above address of the person responsible. We store and use the data you provide for the purpose of processing the contract. After complete processing of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial law retention periods and deleted after the expiry of these periods, unless you have expressly consented to a further use of your data or a legally permitted further use of data was reserved by our side.
8) Comment function
In the context of the comment function on this website, in addition to your comment, information on the time of creation of the comment and the comment name you have chosen will be stored and published on this website. Furthermore, your IP address is logged and stored. This storage of the IP address takes place for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content through a submitted comment. 9) Use of customer data for direct advertising
9.1 Registration for our e-mail newsletter
If you register for our e-mail newsletter, we will send you regular information about our offers. Mandatory information for sending the newsletter is only your e-mail address. The provision of further data is voluntary and will be used to address you personally. For sending the newsletter we use the so-called double opt-in procedure. This means that we will only send you an e-mail newsletter after you have expressly confirmed that you consent to receiving newsletters. We will then send you a confirmation e-mail asking you to confirm that you wish to receive the newsletter in the future by clicking on a corresponding link.
By activating the confirmation link, you give us your consent to use your personal data in accordance with Art. 6 (1) lit. a DSGVO. When registering for the newsletter, we store your IP address entered by the Internet service provider (ISP) as well as the date and time of registration in order to be able to trace a possible misuse of your e-mail address at a later date. The data collected by us when you register for the newsletter is used exclusively for the purpose of addressing you in an advertising manner by way of the newsletter. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a corresponding message to the person responsible mentioned at the beginning. After unsubscribing, your e-mail address will be deleted immediately from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement.
9.2 Sending the e-mail newsletter to existing customers
If you have provided us with your e-mail address when purchasing goods or services, we reserve the right to regularly send you offers on similar goods or services, such as those already purchased, from our range by e-mail. In accordance with Section 7 (3) of the German Unfair Competition Act (UWG), we do not need to obtain your separate consent for this. 9.3 Newsletter dispatch via MailChimp
The dispatch of our email newsletters is carried out via the technical service provider The Rocket Science Group, LLC d/b/a MailChimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (http://www.mailchimp.com/), to whom we pass on your data provided during newsletter registration. This transfer takes place in accordance with Art. 6 (1) lit. f DSGVO and serves our legitimate interest in using a newsletter system that is effective in advertising, secure and user-friendly. Please note that your data is usually transferred to a MailChimp server in the USA and stored there.
MailChimp uses this information to send and statistically evaluate the newsletters on our behalf. For the evaluation, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files that are stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked on. With the help of the web beacons, Mailchimp automatically creates general, non-personal statistics about the response behavior to newsletter campaigns. However, on the basis of our legitimate interest in the statistical evaluation of newsletter campaigns for the optimization of promotional communication and better targeting of recipient interests, the web beacons also collect and utilize data of the respective newsletter recipient (mail address, time of retrieval, IP address, browser type and operating system) in accordance with Art. 6 para. 1 lit f DSGVO. This data allows an individual conclusion to be drawn about the newsletter recipient and is processed by Mailchimp for the automated creation of statistics that reveal whether a particular recipient has opened a newsletter message.
If you wish to deactivate the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.
MailChimp may also use this data itself in accordance with Art. 6 (1) lit. f DSGVO due to its own legitimate interest in the design and optimization of the service to meet needs, as well as for market research purposes, for example to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or to pass them on to third parties.
To protect your data in the USA, we have concluded a data processing agreement ("Data Processing Agreement") with MailChimp based on the standard contractual clauses of the European Commission to enable the transfer of your personal data to MailChimp. As part of Shopify's aforementioned services, data may also be transmitted to Shopify Inc, 150 Elgin St, Ottawa, ON K2P 1L4, Canada, Shopify Data Processing (USA) Inc, Shopify Payments (USA) Inc or Shopify (USA) Inc as part of further processing on behalf of Shopify. Shopify uses this information to send and statistically evaluate the newsletters on our behalf. We have concluded an order processing agreement with Shopify, with which we oblige Shopify to protect the data of our customers and not to pass it on to third parties.

If you subscribe to our availability notification e-mail service, we will send you a one-time e-mail message about the availability of the item you have selected. Mandatory information for sending this notification is only your e-mail address. The provision of further data is voluntary and may be used to address you personally. For sending this notification we use the so-called double opt-in procedure. This means that we will only send you a corresponding notification once you have expressly confirmed that you consent to receiving such a message. 10) Data processing for order processing
10.1 To process your order, we work with the following service provider(s), which support us in whole or in part in the execution of contracts concluded. Certain personal data is transmitted to these service providers in accordance with the following information.
The personal data collected by us will be passed on to the transport company commissioned with the delivery in the context of contract processing, insofar as this is necessary for the delivery of the goods. We pass on your payment data to the commissioned credit institution within the framework of payment processing, insofar as this is necessary for payment processing. With the help of ShopSync, the newsletter service "Mailchimp" is synchronized with our Shopify account in such a way that, on the one hand, updates in Mailchimp email lists (such as a completed opt-out of a newsletter recipient) are also automatically stored on Shopify and, on the other hand, new contact data generated via contract conclusions on Shopify are automatically transferred to the Mailchimp email lists.
In the former case, data processing is carried out pursuant to Art. 6 (1) lit. f DSGVO on the basis of our legitimate interest in the effective and cross-system maintenance of the files of advertising addressees and the efficient observance of legally significant status changes.
In the second case, data is processed exclusively on the basis of an explicit consent of the user pursuant to Art. 6 para. 1 lit. a DSGVO after a contract has been concluded on Shopify for inclusion in the Mailchimp list, the user's first and last name, address and mail address together with transaction-related information (purchase amount, time and date of purchase) are transferred by ShopSync to Mailchimp.
Data transferred in this way are not stored or retained by ShopSync after synchronization. All information synced between Shopify and Mailchimp is transmitted using Secure Socket Layer (SSL) technology, and all information transmitted remains encrypted during the sync process.
The sync process requires the transmission of information over a secure connection to servers hosted by Amazon Web Services in the United States.

18) Data Subject Rights
18. 1 The applicable data protection law grants you comprehensive data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, which we inform you about below:
- Right of access pursuant to Art. 15 DSGVO: In particular, you have a right of access to your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the planned duration of storage or. the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, to object to processing, to lodge a complaint with a supervisory authority, the origin of your data if it has not been collected from you by us, the existence of automated decision-making, including profiling, and, where applicable, meaningful information about the logic involved and the implications for you and the intended effects of such processing, as well as your right to be informed about the safeguards pursuant to Art. 46 DSGVO when your data is transferred to third countries;
- Right to rectification pursuant to Art. 16 DSGVO: You have a right to immediate correction of inaccurate data concerning you and/or completion of your incomplete data stored by us;
- Right to erasure pursuant to Art. 17 DSGVO: You have the right to request the deletion of your personal data if the conditions of Art. 17 (1) DSGVO are met. However, this right does not exist in particular if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
- Right to restrict processing pursuant to Art. 18 DSGVO: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data disputed by you is verified, if you refuse to delete your data because of unlawful data processing and instead request the restriction of the processing of your data, if you need your data for the assertion, exercise or defense of legal claims after we no longer need this data after the purpose has been achieved, or if you have objected on the grounds of your particular situation, as long as it is not yet clear whether our legitimate reasons prevail;
- Right to information pursuant to Art. 19 DSGVO: If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
- Right to data portability pursuant to Art. 20 DSGVO: You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller, insofar as this is technically feasible;
- Right to withdraw consent given pursuant to Art. 7 (3) DSGVO: You have the right to revoke consent to the processing of data once given at any time with effect for the future. In the event of revocation, we will delete the data concerned without delay, unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation;
- Right to complain under Article 77 GDPR: If you consider that the processing of personal data concerning you infringes the GDPR, you have - without prejudice to any other administrative or judicial remedy - the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, workplace or the place of the alleged infringement.
18. 2 RIGHT OF REVIEW
If WE PROCESS YOUR PERSONAL DATA IN THE CONTEXT OF AN INTEREST PROCESSING ACTION ON THE BASIS OF OUR OVERRIDING LIGIBLE INTEREST, YOU HAVE THE RIGHT TO OBJECT TO SUCH PROCESSING AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, WITH EFFECT FOR THE FUTURE.
IF YOU EXERCISE YOUR RIGHT OF OBJECTION, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO CONTINUE PROCESSING IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OVERRIDE YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING IS FOR THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS.
If YOUR PERSONAL DATA IS PROCESSED BY US FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING. YOU MAY EXERCISE THE RIGHT TO OBJECT AS DESCRIBED ABOVE.
If YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT ADVERTISING PURPOSES.
19) Duration of storage of personal data
The duration of storage of personal data is measured on the basis of the respective legal basis, the purpose of processing and - if relevant - additionally on the basis of the respective statutory retention period (e.g. retention periods under commercial and tax law).
When personal data is processed on the basis of explicit consent pursuant to Art. 6 (1) a DSGVO, this data is stored until the person concerned revokes his or her consent.
If there are statutory retention periods for data that is processed within the scope of legal or quasi-legal obligations on the basis of Art. 6 (1) lit. b DSGVO, this data will be routinely deleted after expiry of the retention periods, provided that they are no longer required for the performance of the contract or contract initiation and/or there is no legitimate interest on our part in the continued storage.
When processing personal data on the basis of Art. 6 para. 1 lit. f DSGVO, this data will be stored until the data subject exercises his right to object pursuant to Art. 21 (1) DSGVO, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the purpose of asserting, exercising or defending legal claims.
When processing personal data for the purpose of direct marketing based on Art. 6 (1) lit. f DSGVO, this data will be stored until the data subject exercises his or her right to object pursuant to Art. 21 (2) DSGVO.
In addition, unless otherwise stated in the other information in this statement about specific processing situations, stored personal data will be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
